Regulations Governing the Examination Procedure and Process

List of participants
- Only those students who have duly registered for the relevant exam are eligible to take the exam. Consequently, only students who are listed on the attendance register or whose eligibility can be confirmed by the Examination Office following a telephone enquiry by the invilgators may take the exam. Under no circumstances may students be admitted ‘subject to confirmation’!
- The Exams Office / Exams Orga draws up an alphabetical list of participants for the exam participants in the room (List I), where applicable, a further list (List II) containing the details of those during the same exam in a different room. If students listed on the second list of participants report to the invilgators that they are in the wrong room, but are allowed to take the exam the, they can take the exam in the room.
- The exam rooms should be prepared before the start of an examination so that candidates can take their seats immediately. The invilgators are responsible for allocating seats to the exam candidates. In doing so, they must ensure that there is sufficient space between the individual seats to prevent any attempts at cheating.
Identity documents
Participants must bring the following to the written examination:
- their student ID card and
- an official identity document with a photograph.
It is essential to present a valid official photo ID (identity card or passport) in addition to your student ID card in order to verify your identity. This is to ensure that no one else sits the exam in your place.
- If the valid official photo ID or student ID card is not available at the examination desk,
- but is in their bag, jacket or similar, the student ID card or photo ID will be retained until the end of the exam. Afterwards, the student may present the valid official photo ID or student ID card and will have the retained ID returned.
- If neither the official photo ID nor the student ID card is available, the student will notbepermittedto sit the examination. The student must leave the room immediately.
- If only one of the two forms of identification is available:
- To verify the student’s identity, the invigilators will take a photograph of the student together with the available ID card.
- The student must contact Yvonne Homeyer (R12 R07 B22) or Maik Hetmank (R12 R07 B32) on the next working day to provide proof of the missing ID.
- Until the student’s identity has been definitively confirmed, the exam must not be graded and no grade must be submitted to the Examinations Office.
Exam-taking
- Before distributing the exam papers, the invilgators must inform the candidates that the exam time does not begin until all the exam papers have been distributed. The exam papers must be handed out face down and may only be turned over by students once all the papers have been distributed (‘All exam papers have been handed out. The examination time begins now.’).
- Whilst sitting the exam, candidates must place their personal identification document and student ID card on their desk. During this time, invigilators shall verify the candidates’ identity and eligibility to sit the examination. In the event of unauthorised participation, the candidate must be prevented from continuing the examination and must be removed from the room. This procedure must be recorded in the minutes.
- The permitted aids (e.g. calculator, law texts) are listed on the cover sheet of the exam paper. In particular, briefcases and any items of clothing removed must be deposited at a location to be designated by the invigilators.
- For written examinations, only the examination paper stamped by the Examinations Office or the task papers prepared by the examiners may be used. Candidates will be issued with exactly one examination paper or the question papers prepared by the examiners in advance. The issue of any additional sheets, as required, must be noted on an examination sheet. At the start of the written examination, candidates must be informed that all examination sheets must be numbered consecutively and that, upon completion of the examination, all examination sheets – including those left blank – must be handed in.
- A reading period is permitted for questions selected from a range of options. However, this applies only if this is noted on the exam cover sheets. If there is no information regarding a reading period on the exam cover sheets, no reading period may be granted.
- Examination invigilators are prohibited from providing hints, explanations or similar guidance regarding the examination questions set.
- Any candidate sitting a written examination is free to make a note in the exam record. The note must be identified as the candidate’s personal opinion.
Trips to the toilet
- Before the exam begins, a invigilator will carry out a visual inspection of the toilet facilities nearest to the examination room.
- To ensure that the examination proceeds as smoothly as possible, toilet breaks should be limited to what is strictly necessary.
- During the first and last 15 minutes of the examination, students are not permitted to use the toilets.
- Students must raise their hand to signal their intention and wait until a invigilator is at their station, or, upon being asked to do so by the invigilator, proceed to the invigilator’s station to request permission to use the toilet.
- The exam paper and student ID must be handed to the invigilator before leaving the examination room.
- Only one candidate may leave the examination room at any one time.
- The absence must be recorded in the examination log or in the relevant app (student number, time of departure and return).
- You must use only the toilet closest to the examination room.
- An invigilator will check that you have used the nearest toilet facilities and returned to the examination room immediately afterwards.
Withdrawal from the exam due to acute illness
- If a candidate falls ill during an exam, the invigilators must instruct them to provide a medical certificate without delay.
- If a candidate leaves the exam early, they must state for the record that they are withdrawing from the exam due to an acute illness.
- The invigilators must record this fact in the exam report, stating the exact time.
- The candidate must go to a doctor immediately and obtain a medical certificate stating the expected duration of the illness, the medical findings, the nature of the impairment resulting from the illness, the date of the examination, and bearing the doctor’s stamp and signature.
- The medical certificate must be forwarded without delay (in accordance with Section 121 of the German Civil Code (BGB)) either in person or by registered post to the Exams Office, together with a declaration releasing the certifying doctor from his duty of confidentiality in this instance.
Compensation for disadvantages
- In the event of a long-term illness, the right to withdraw from the examination on the grounds of that illness is forfeited upon attending the exam.
- Special arrangements, e.g. extensions to the exam time or permission to use the toilet due to long-term medical conditions associated with disabilities, may, in accordance with the relevant exam regulations, only be granted upon presentation of a relevant medical certificate prior to the examination (see: compensation for disadvantage).
Cheating and Deception
- In the event of suspected attempts at cheating, invigilators may inspect examination answer sheets and authorised aids. If a candidate refuses to allow such an inspection, this incident must be recorded. Any attempts at cheating that are detected must also be recorded by the invigilators. Any unauthorised aids used or carried by the candidate must be confiscated by the invigilators. The candidate must be permitted to continue the examination. Breaches of the rules must be recorded.
- The use of mobile phones during an examination is not permitted. Any mobile phones brought into the exam room must be switched off, must not be visible, must not be accessible and must not be left on the examination desk. Where possible, mobile phones must be stored at the edge of the room or with the invigilator.
The use of mobile phones during an examination will, in all cases, be regarded as an attempt to cheat.
Early Hand-Ins
- If a candidate leaves the exam room without the invigilator’s permission, they may not re-enter it.
- Exam papers may only be handed in early up to 15 minutes before the official end of the examination time. After that, all candidates must remain at their seats until the exam time has elapsed and all exam papers have been collected by the invigilators.
- The early hand-in of an exam must be recorded.
End of exam time
- The invigilators will signal the end of the exam time. Students are reminded that they must stop working on the exam immediately and that all candidates must remain at their seats. Anyone who fails to comply is guilty of attempted cheating.
- At the end of the exam, the invigilators will hand over the exam papers, the exam tasks and the exam record to the research group of the corresponding examiner/professor who conducted the examination.
